Worked for me!
For Win 7
Close all Blizzard related games and downloads
Start Task Manager
Dump all "agent.exe *32" processes
Right Click on "Diablo-III-Setup-enUS.exe" (or other versions)
Check "Run this program in compatibility mode for:"
Select Windows XP (Service Pack 3)
Right Click "Diablo-III-Setup-enUS.exe" (The one you just changed)
Run as Administrator
Diablo 3 should load.

Followed the instructions "REMOVE BATTLE.NET FOLDER", moved them to the dustbin and opened Diablo III again. Now it updates the Blizzard agent, got stuck for just a few seconds, but then finished and opened the bigger screen with the big PLAY-button. Yay it worked!
PS: This worked for Mac ;)
