i installed diablo twice, and both times it would crash right after i got to the main menu screen. i switched the compatabiliy mode to windows xp sp3 and it works fine, is there anything wrong with this? if so is there a fix?

Have you read the logs? Located at C:\Program Files (x86)\Diablo III\Logs by default.
