The new legendary has created a number of new issues by shattering some of the prior precedents applied to legendaries and their distribution. Seeing as this particular legendary can be awarded to anyone, and we have yet to see it's final form (and therefore can't determine who it will benefit the most), the decision to award it to someone has boiled down to being arbitrary - at least for me.
Realistically I cannot justify giving it to someone based on game mechanics - we just have no idea who will get the most out of it. Since we have to assume that EVERYONE can benefit from it a great deal, choosing the methods of giving out legendaries has a been an excercise in delicacy and transparency.
So fellow guild leaders; how have you handled the item's awarding?
Just because there's more people who can benefit from it doesn't mean the methods of choosing who gets it need to change.
Look at your guild rules for distribution, make any tweaks (example, maybe you require they have the 'get black prince rep to honored' quest done) and go from there. The concepts behind choosing who gets the legendary still applies.
Not sure how any issues have been created yet when the quest is an individual one for this tier. Everyone can be on it and collect sigils simultaneously, even in LFR. In fact for this tier I'd say all the issues surrounding prior legendaries have been removed.
The legendary may become restricted to a certain class/role/spec in some future content patch, but why are you looking for trouble now when none exists?
We had exactly one raider who made it through Cata without taking a break (GL took his in Firelands, I took mine after HMadness went down). He was one of our top dps in DS, is always on time, rarely takes a raid day off, is always willing to help guildies. For us it was an easy choice.
If there are more to be handed off we will likely give it to top dps.
There's a good MMO-Champion thread on this topic, in which Ghostcrawler comes out and says that the reason behind the mystery and the new quest line for the legendary is that the dev team wanted to help guilds avoid the "who gets the legendary" drama.
One of our goals with the Legendary in 5.0 is to remove some of the guild headaches and drama often associated with Legendaries. Everyone can begin working on getting a Legendary immediately, even if you use LFR. (You'll be able to gather faster with your guild, though.) Getting the final legendary (whatever form it takes) won't be an easy feat - you'll have to participate in content throughout ALL the patches.
For now, I'm taking him at his word and assuming this won't be a decision I have to make. We've been divvying out legendaries since Ulduar, so it wouldn't take long to figure things out if the reality doesn't quite live up to the promise.
